Supreme Court Stay of the Clean Power Plan

The recent U.S. Supreme Court decision to put a hold, or stay, on the EPA’s Clean Power Plan (CPP) for existing power plants is unprecedented. The American Coal Council anticipates that several of our speakers will address the various implications of this action for the electric sector and related stakeholders. Additionally, a special focus on the legal aspects of this extraordinary development has been added.
Paul Seby of Greenberg Traurig represents North Dakota in the CPP litigation. North Dakota received one of the four stay orders from the Supreme Court. Paul will join us to discuss the immediate impacts of the stay, emphasizing the states’ specific role and responsibilities. He will also discuss the lower court case at the DC Circuit Court of Appeals, where a decision is expected by the end of 2016 due to an expedited schedule.
Yet another factor in this evolving story is the uncertainty over how long the Supreme Court will be without a ninth justice.
